Terms of Service
Effective October 29, 2026
These Terms of Service ("Terms") govern your access to and use of the website at https://consentvault.ai (the "Site"), the ConsentVault.AI early-access program, the field guide and any related products, services and communications provided by The Innovative Native LLC, a Florida limited liability company and the maker of ConsentVault.AI ("ConsentVault," "we," "us," or "our"). By accessing or using the Site, joining early access, or requesting or receiving our services or communications, you agree to be bound by these Terms. If you do not agree, do not use the Site or our services.
1. Acceptance of Terms
By accessing the Site, submitting a form, joining early access, downloading the field guide, or otherwise communicating with us, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. These Terms apply to all visitors, users and customers.
2. Eligibility
You must be at least 18 years of age and able to form a legally binding contract to use the Site or request our services. If you use the Site on behalf of a business, you represent that you are authorized to accept these Terms for that business. You represent and warrant that any information you provide is accurate and truthful.
3. Early Access
ConsentVault.AI is in early access. Joining the early-access list does not create a subscription, a purchase or an obligation on either side. Features, availability, timelines and pricing may change or be withdrawn at any time without notice. Any pre-release software, demonstration or pilot we provide is offered "as is," without a service level, and may be governed by a separate written agreement, which controls over these Terms where the two conflict.
4. Not Legal Advice
ConsentVault.AI provides software, education and operational direction behind decisions toward compliance. We are not a law firm and we do not provide legal advice. Nothing on the Site, in the field guide, in any demonstration or in any communication from us creates an attorney-client relationship or should be relied on as legal advice. Consent, telemarketing and privacy law vary by jurisdiction and change often; consult your own counsel about your disclosures, contact practices and obligations. You remain solely responsible for your own compliance.
5. Use of the Site and License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site to learn about and request our products and services. You agree not to misuse the Site, interfere with its operation, probe or test its security without our written permission, attempt to gain unauthorized access to any system, scrape or copy it at scale, or use it for any unlawful purpose.
6. Intellectual Property
All content on the Site, including text, graphics, logos, the ConsentVault name and mark, images, designs, software and the field guide, together with all rights, title and interest in them, is owned by The Innovative Native LLC or its licensors and is protected by applicable intellectual-property laws. No intellectual-property rights are transferred to you by your use of the Site. You may download and share the field guide unmodified for your own internal, non-commercial use; you may not sell it, repackage it, or create derivative works from any content without our prior written permission. Certain interface components on the Site are used under their authors' licenses.
7. User Submissions and Conduct
When you submit information through a form or other communication, you represent that the information is accurate, that it is your own or that you have the right to provide it, and that any phone number you provide is yours. You agree not to submit content that is unlawful, misleading, infringing, defamatory or otherwise objectionable. You are responsible for maintaining the confidentiality of any account credentials we issue to you and for all activity under your account. Notify us promptly of any unauthorized use.

By submitting a form or providing your contact information, you authorize The Innovative Native LLC and its service providers to contact you at the email address, phone number or mobile number you provide, including by email, phone call, text message, and automated dialing or prerecorded or artificial voice technology, about your early-access request, onboarding, product updates and customer care. How we keep your consent. We record the exact wording you agreed to, the time from our server, the address and browser your request came from, and a fingerprint chaining your request to the one before it, so that your consent and any later opt-out can be proved exactly as given.
10. Third-Party Services and Links
The Site may reference or link to third-party websites, standards, products or services. Your use of any third-party service is at your own risk and is governed by that third party's own terms and policies. We do not control and are not responsible for the content, policies or practices of any third party, and we disclaim liability for any damages arising from your use of them.
11. Disclaimer of Warranties
The Site, the field guide, any early-access software and all content are provided on an "as is" and "as available" basis. You assume full responsibility for using them at your own risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site or any software will be uninterrupted, secure or error-free, or that using them will make you compliant with any law.
12. Limitation of Liability
To the fullest extent permitted by law, The Innovative Native LLC and its owners, managers, officers, employees, contractors and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue or data, or any regulatory fine or third-party claim, arising out of or related to your use of the Site, the field guide, any early-access software or these Terms, whether based in contract, tort or any other legal theory, even if advised of the possibility of such damages.
13. Indemnification
You agree to indemnify, defend and hold harmless The Innovative Native LLC and its owners, managers, officers, employees, contractors and service providers from and against any claims, liabilities, damages, losses and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Site or our services, your contact practices, your violation of these Terms, or your violation of any law or any rights of a third party.
14. Termination
We may suspend or terminate your access to the Site or early access at any time, with or without notice, for any reason, including violation of these Terms. Provisions that by their nature should survive termination, including intellectual-property rights, disclaimers, limitation of liability, indemnification and the arbitration agreement, will survive.
15. Dispute Resolution, Including Mandatory Arbitration and Class Action Waiver
Any controversy, claim or dispute arising out of or related to these Terms, the Site, our services, or any call, text message, email or other communication from us or on our behalf, including alleged violations of state or federal statutory or common law rights or duties between you and us, and including any that arose before you agreed to these Terms (a "Dispute"), shall be solely and exclusively resolved according to the procedures in this Section. If the parties are unable to resolve a Dispute informally, either party may initiate binding arbitration by sending notice demanding arbitration to the other party. Notices to us under this Section must be sent to info@theinnovativenative.com with the subject line "Demand for Informal Dispute Resolution"; a notice is effective when we receive it. The demand for arbitration must be made within the time allowed by the applicable statute of limitations.
The arbitration shall be initiated and conducted under the American Arbitration Association's Consumer Arbitration Rules (the "Arbitration Rules"), by video or in the county where you live, before a single neutral arbitrator appointed under the Arbitration Rules. Either party may instead bring a Dispute in small claims court in the county where you live, to the extent permitted by the Arbitration Rules. If the amount in controversy is less than $10,000, the Dispute will be decided on written submissions without a hearing. The arbitrator's decision is final without option to appeal. Arbitration costs and fees are divided under the Arbitration Rules. Each party pays its own attorneys' fees, costs and expenses regardless of which party prevails, unless the arbitrator, applying applicable law, determines otherwise.
No Dispute may be arbitrated on a class or representative basis, and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated. BY AGREEING TO THESE TERMS, EACH PARTY IRREVOCABLY WAIVES ANY RIGHT IT MAY HAVE TO JOIN CLAIMS OR DISPUTES WITH THOSE OF OTHERS IN THE FORM OF A CLASS ACTION, CLASS ARBITRATION OR SIMILAR PROCEDURAL DEVICE, AND WAIVES ANY RIGHT IT MAY HAVE TO PRESENT ITS CLAIM OR DISPUTE IN A COURT OF LAW OR BEFORE A JURY. Judgment on the award may be entered in any court having jurisdiction.
Mass arbitration. If twenty-five (25) or more similar claims are asserted against us at or around the same time by the same or coordinated counsel, or are otherwise coordinated, and your claim is one of them, you agree that resolution of your claim may be delayed. Before any such claim is filed in arbitration, the claimant must send us an individual written notice of the claim, personally signed by the claimant (and the claimant's lawyer, if any), describing the claim and the relief sought, and the parties must try in good faith to resolve it informally for sixty (60) days. The AAA's mass arbitration rules and fee schedule then in effect apply. Twenty (20) claims (ten selected by the claimants and ten by us) proceed first as individual arbitrations; the remaining claims are not filed or deemed filed, and no AAA fees are assessed on them, until selected. If the remaining claims are not resolved after those twenty, the parties attend a global mediation before a retired state or federal judge, with the mediator's fee paid by us. If mediation does not resolve them, forty (40) more claims (twenty selected by each side, or all if fewer remain) proceed, followed by another global mediation on the same terms, and then staged batches of no more than one hundred (100) claims at a time, in an order selected randomly or by the AAA, unless a Process Arbitrator appointed under the AAA's rules orders otherwise to avoid unreasonable delay. Each proceeding decides only its own claim and has no preclusive effect on any other. Statutes of limitations and filing-fee deadlines are tolled from the time we receive notice of a claim until it is selected, withdrawn or resolved. A court of competent jurisdiction may enforce this paragraph and, if necessary, enjoin the filing or prosecution of arbitration demands against us. If a court declines to enforce it, the parties' counsel will work in good faith with a Process Arbitrator to devise procedures that keep arbitration efficient and cost-effective for all parties.
If we change this Section, the change will not apply to any Dispute that arose, or that we had notice of, before the change takes effect. This Section is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Except for Disputes resolved under Section 15, any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts serving St. Lucie County, Florida, and you consent to the personal jurisdiction and venue of those courts.
17. Changes to These Terms
We may update these Terms from time to time. For material changes we will give notice, such as by posting the updated Terms on the Site with a new effective date. Your continued use of the Site or our services after changes take effect constitutes acceptance of the revised Terms.
